Terms of Service

These terms are an agreement between you and ProductInk (“ProductInk”, “we”, “us”) for the use of productink.ai, the ProductInk Chrome extension and the videos they make (together, the “Service”). By creating an account or using the Service you accept them. If you use the Service for a company, you accept them for that company and confirm you may do so.

1. The beta

The Service is in beta and is free while it is. Features may change, be limited or be removed, and the Service may be unavailable at times. We will give you reasonable notice before introducing paid plans; nothing you have made becomes paid without your agreement.

2. Your account

You must be at least 16 years old and give accurate details. Keep your password and the extension’s sign-in private; you are responsible for what happens in your account. Tell us at help@productink.ai if you think someone else has used it.

3. Your content

“Your content” is what you record, upload or type into the Service (recordings, screenshots, narration, brand kits, chat messages) and the videos made from it. You own your content. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process and display it only to run the Service for you: to store it, transcribe it, make and edit your videos, render them, and show them where you share them. This licence ends when you delete the content, except for copies in backups, which expire on their normal schedule.

You confirm you have the rights to everything you record and upload, including any personal data and third-party material that appears on screen, and that your content does not break the law or anyone’s rights.

4. AI-generated output

ProductInk uses AI to write voiceover lines, captions and directions and to produce voices. AI output can be inaccurate or unsuitable. Review every video before you publish it; you are responsible for what you publish.

5. Sharing

When you share a video, anyone with its link can watch it, and an embed shows it on any website where you place it. You can stop sharing at any time; the link then stops working.

6. Acceptable use

Do not use the Service to:

• record or publish content you have no right to, or other people’s personal data without a lawful basis;
• make content that is illegal, deceptive, harassing or infringes intellectual property;
• break, probe or overload the Service, get around its limits, or access other people’s accounts or data;
• copy, resell or reverse-engineer the Service, or use it to build a competing product.

We may remove content or suspend accounts that break these rules.

7. Our property

The Service, its software, design and brand belong to ProductInk and its licensors. These terms give you the right to use the Service, not ownership of it. If you send us feedback, we may use it without obligation to you.

8. Third-party services

The Service relies on providers for hosting, storage, AI and voice (listed in our Privacy Policy). Their outages may affect the Service.

9. Ending

You can stop using the Service and delete your projects at any time, or ask us to delete your account at help@productink.ai. We may suspend or end your access if you break these terms or if we stop offering the Service; where we can, we will give you notice and time to download your videos.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability and non-infringement, to the extent the law allows.

11. Limitation of liability

To the extent the law allows, ProductInk is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. Nothing in these terms limits liability that cannot be limited by law.

12. Changes to these terms

We may update these terms. If a change is significant we will tell you by email or in the app before it takes effect. Using the Service after a change means you accept it.

13. Law

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, and disputes will be heard in the courts located there, unless the law where you live gives you the right to bring them elsewhere.
